Any confirmed order involves the seller and the consumer – natural or legal person in a distance contract. The distance contract is concluded between AL-KIMIYA RETREAT SRL, as a seller and a consumer-buyer, within the present online sales system organized by AL-KIMIYA RETREAT SRL, using exclusively, before and at the conclusion of this contract, the remote communication technique included as the main functionality in the online store; The moment of the conclusion of the distance contract with the natural person, respectively, of the conclusion of the sales contract with the legal person, is the moment of receipt by e-mail of the confirmation message by the consumer, regarding his order. The provisions of this distance contract are supplemented by the provisions of Law 365/2002 on electronic commerce, republished and amended, and GEO 34/2014 on consumer rights in contracts concluded with professionals. AL-KIMIYA RETREAT SRL accepts the conclusion of distance contracts by electronic means and thus undertakes to comply with the legislation applicable to the conclusion, validity and legal effects of these contracts. In the contents of this document, the following terms used in capital letters will have, if the context does not indicate otherwise, the meanings specified below: USER: any person who visits and/or interacts with the AL-KIMIYA RETREAT SRL website Orders can be placed online at any time, but their processing period takes place from Monday to Friday between 9:00 and 18:00. Orders placed on Saturdays and/or Sundays and/or legal holidays will be processed on the next working day. If the client is new, the seller assumes the acceptance of the order from the buyer when there is a telephone confirmation or electronic validation. The electronic validation represents the verification and confirmation of the online payment with the bank card and implicitly the verification of all the customer’s identification data and the shipping address. If the prices or other information about the product were displayed incorrectly, the Seller reserves the right not to honor the order and to notify the customer about the error, if the delivery was NOT made. The ordered products may differ in terms of some characteristics (e.g. color shades) compared to the actual appearance of the product, depending on the manufacturing batch. In order to carry out the distance contract in good conditions, AL-KIMIYA RETREAT SRL, based on the agreement expressed by the client, can contact the client by e-mail or telephone, only if, following the interaction with the site, the Client completes the identification and contact data . The purpose in which the client will be contacted is Only and Only to expressly request information intended to complete the online ordering process. At the request and with the agreement of the buyer, AL-KIMIYA RETREAT SRL can recommend to the buyer the purchase of another product of a quality and at a price equivalent to the one requested in the initial order. The initial order is considered canceled on the date of confirmation of the order of the product/products that replace the initial product. All prices related to goods in the online store are expressed in lei, euro, usd (RON, USD, EUR). Product prices can be updated daily. The price of the ordered product is the one displayed on the date of placing the order. The customer can place an online order from the product listing page or from the individual product page, and complete the order after selecting a payment and delivery method. The products added to the shopping basket do not attract the registration of the order or the reservation in the store of the goods added to the basket. For the successful completion of the order process, the customer assumes that all his contact data are complete and correct. The seller reserves the right to cancel the order placed by the buyer, in one of the following cases: • If the payment was not accepted by the payment processor approved by AL-KIMIYA RETREAT SRL – the data provided by the client are incorrect/incomplete; • The card/transaction is not accepted by the issuing bank; • Delivery by courier/arabianretreat.ro means of transport was not possible (e.g. the customer cannot be found by telephone and/or physical courier at the address indicated for the delivery of the purchased goods, etc.); • If the price of the product is ridiculous (as defined in Art. 1665 of the Civil Code) • If the user/buyer has or has had abusive behavior, or has other intentions than to purchase products and services offered through this platform. • If the user/buyer has requested the deletion of all personal data requested when creating a customer account, in case he creates another account, AL-KIMIYA RETREAT SRL reserves the right to delete and block the new customer account and reserves the right to block his action to create a new account in the future, confiding these actions to abusive behavior. In case of cancellation of the order, none of the involved parties will claim/request damages. Thus, the client has the possibility to have a record of the invoices issued. In order to successfully complete the online ordering process, the customer has the obligation to update the personal information in his account. If the invoice is not available in the customer’s account, within a maximum of 48 hours after receiving the goods, he is asked to send a notification to the e-mail address contact@arabianretreat.ro . In certain situations, the shades and characteristics may differ slightly from those presented on the website, depending on availability, batch and type of material. The seller is responsible for the proper packaging of the goods. The risk of damage to the good is transferred to the buyer at the moment of the actual delivery of the good. The seller assumes responsibility for the delivery of the products ordered by the buyer. The Seller undertakes to deliver the goods through the agreed courier companies or arabianretreat.com means of transport, according to the Customer’s choice. The goods are delivered only on the territory of Romania and the countries of the European Union. The buyer has the right not to accept the delivered goods if they do not comply with the technical details specified on the product page. In this case, the Seller assumes the responsibility of bringing the products into compliance. The buyer will take ownership of the goods after signing the transport document and making the payment (if it was not previously made by card) to the courier or arabianretreat.com staff. Force majeure (unforeseeable, uncontrollable and unavoidable event that affects the performance of the contract) exempts the party that invokes it from liability. Litigation.
